Terms of Trade

Definitions:

“Magnets Australia”, “Company”, “we”, “us”, or “our” refers to Magnets Australia, a company part of the Magnets Group of companies located at 142 Bush Road, Rosedale, Auckland (0632), New Zealand

“Customer”, “Applicant”, “client”, “you”, or “your” refers to the company, partnership, individual or sole trader entering into this agreement.

Details such as; Your name, delivery and billing address, email address, phone number, age, any order history that you have previously purchased or enquired about, and any additional information relating to you that you provide us. This information is held securely by Magnets New Zealand Limited and is not for resale.

This information is held in order to assist us to better the level of service we can provide to you and to improve our website so it is easier to find what is relevant to you.

 

1. Website pricing

1.1 – Advertised Website Pricing
The price you pay is inclusive of GST, but exclusive of freight and other taxes or duties which may be applicable to your order (except to the extent already expressly included in the price). We can revise our prices at any time prior to accepting your order.
Purchase prices are given in Australian dollars unless otherwise stated. You are bound to pay us the price once we accept your order. A quotation does not give rise to a binding contract until you place an order which we subsequently accept.

For larger orders that are not included in our website price break discounts or for trade customers, a larger discount may be available to you. Please contact us to ask regarding a larger quantity discount.

In the rare event of a website pricing error displaying the incorrect price of any products or services, we reserve the right to cancel and refund any affected orders at our sole discretion.

1.2 – Price Match Guarantee
Our price match guarantee is only available for identical products (magnet grading, size, plating, etc.) and is only eligible for other Australian based businesses operating within Australia with a valid ACN. Products must be available for dispatch and not drop shipped. This guarantee may be discontinued at any time without prior notice.

1.3 – Promotional Pricing
Any pricing promotions may be discontinued without prior notice. However, any orders received during the pricing promotion will remain eligible for any discounts where they may apply. Unless stated, promotions may not be used in conjunction with one another. This also includes any special pricing discounts associated with any single customer account such as though our Loyalty System.
Unless otherwise stated discounts will not be applied to freight.

1.4 – Quotations
Should you require a written quotation for your order, please email us so we can raise a quote for you.
Quotes are valid for 30 days from the quotation date unless otherwise stated and any changes in order quantities will void your quotation, quotes older than 30 days or older than the stated date are no longer valid.

2. Payment methods

2.1 – Available Payment Methods
We offer the following payment methods for sales on and off our website
Credit cards, online EFTPOS (Visa, MasterCard) By Worldlines CLICK and Online EFTPOS gateway, AfterPay or by Bank Transfer

You must not pay, or attempt to pay, for products through any fraudulent or unlawful means through any payment gateway.

Magnets Australia will provide you with a receipt at the time of delivery which specifies the total fees for the products in the order.

“Payment details are not stored by Magnets Australia” means that any card details used during the transaction are process by the Worldine gateway (Paymark) or account details used used by the AfterPay gateway and are not stored on our site and Magnets Australia cannot access these records. *Exception is to process refunds where the gateway provider retains your records.

2.1.1 – Credit Card/EFTPOS Payments
Credit card payment is processed through the WorldLine gateway. If you choose to pay by credit card/Online EFTPOS, you authorise us to debit the amount that is payable for an accepted order from your nominated credit card.

2.1.2 – AfterPay Payments
Orders placed using the AfterPay gateway are processed and dispatched once your order has cleared the providers site. You choose to pay using AfterPay that you authorise us to debit the amount payable for an accepted order from your nominated account.

2.1.3 – Bank Transfer (EFT) Payments
For orders being paid for by “Bank Transfer” a $40.00 processing fee is applied to all orders to cover any bank fees with your transaction. Please email info@magnetsaustralia.com.au to raise an invoice.

2.1.4 – Trade Accounts
For orders being paid for by “Trade Account” gateway which is only available to authorized customers with a credit account.
On each statement with active transactions a $40.00 processing fee is applied to cover any bank fees. Any orders placed under your authorized “Trade Account” is subject to our standard account terms and conditions as outlined on your credit application.

3. Description of products

3.1 – Accuracy of goods
Magnets Australia cannot warrant or guarantee that the content of the website will always be current, accurate or complete. Descriptions, illustrations, and literature are therefore not binding on the seller. If the goods do not match the description on the seller’s website, the buyer should inform the seller immediately so that the seller may take appropriate action to correct the product listing and offer corrective actions.

 

4. Incorrect supply/Damaged Goods

4.1 – Incorrect supply
Incorrect supply of your order must be reported to Magnets Australia within 5 days of receipt of goods. Magnets Australia will then remedy the problem as soon as possible.
A query must be raised within 10 days of the stock being dispatched, failure to raise a query within this time will result in no refund given with your order.

4.2 – Damaged Goods
Damaged goods must be reported to Magnets Australia within 5 days of receipt of goods. Magnets Australia will then remedy the problem as soon as possible and where possible dispatch replacement goods free of charge.
A query must be raised within 10 days of the stock being dispatched, failure to raise a query within this time will result in no refund given with your order.

 

5. Availability of stock

5.1 – Stock availability
Magnets Australia cannot guarantee the availability of stock at all times and as a result, reserves the right to cancel an order due to short supply. You will be notified that your order has been placed on backorder and if payment has been made a full refund will be offered if you do not wish to wait for your backorder of stock. If you have been affected by a shortage of stock you will be notified by one of our staff.

We also reserve the right to withdraw or suspend the sale of any items displayed on our website, whether temporarily or permanently, at any time without prior notice. We are not responsible for any loss, damage or expenses incurred by you, or any other person directly or indirectly as a result of the unavailability of stock at any time.

 

6. Returns & refunds

6.1 – 30 Day Return Policy
Magnets Australia have a 30 day return policy on all stock items. Any specially procured items at the buyer’s request, custom made items or clearance items are not eligible for our 30 day return policy.
This 30 days applies from the date of order not date of delivery.
All items must be in an unused condition in order to be refunded. Should you wish to return an item within this timeframe, please contact us to arrange a return.

The buyer is responsible for the cost of returning the goods to the sender and must be packed in a safe manner to not only protect the goods but satisfy the shippers conditions for freighting dangerous goods.

Once the goods have been approved for return please address them to the address below and include a copy of your invoice.

Should your goods be rejected by the carrier or be stopped at a gateway, Magnets Australia will not be responsible for any additional costs incurred.

 

6.2 – General returns outside of our 30 day policy
Goods being returned outside our 30 day return policy are subject to approval by Magnets Australia. Should the goods be approved for return they must meet the below criteria.

  1. Goods must be returned in their original packaging, and both the goods and packaging must be in brand-new condition.
  2. Goods being returned for a refund beyond 30 days of purchase will incur a 20% restocking fee.
  3. Returned items must include the name and details of the purchaser and the original invoice number.
  4. Shipping charges for returned purchases will not be refunded, and returned goods will be at purchaser’s risk until received by Magnets Australia.
  5. In the case of a credit card refund, the refund will only be made to the same credit card used in the original purchase.
  6. The return freight is paid by the buyer.
  7. Specially procured items at the buyer’s request, custom made items or clearance items are non-returnable and non-refundable.

7. Liability

7.1 – Liability Clause
7.1.1 – Magnets Australia shall not be liable for:

Any loss or damage of any kind whatsoever, arising from the supply of Goods by Magnets Australia to the Customer including consequential loss whether suffered or incurred by the Customer or another person and whether in contract or tort (including negligence) or otherwise and irrespective of whether such loss or damage arises directly or indirectly from Goods provided by Magnets Australia to the Customer; and

The Customer shall indemnify Magnets Australia against all claims and loss of any kind whatsoever however caused or arising and without limiting the generality of the foregoing of this clause whether caused or arising as a result of the negligence of Magnets Australia or otherwise, brought by any person in connection with any matter, act, omission, or error by Magnets Australia its agents or employees in connection with the Goods

Any claim against Magnets Australia shall be limited to the value of the goods supplied and is not responsible for the direct or indirect costs associated with the order.

7.1.2 – Legal Jurisdiction
The legal jurisdiction of this agreement resides within the State of New South Wales, Australia

If any provision of the Terms & Conditions of Sale is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of the Terms & Conditions of Sale, which shall remain in full force and effect.

Any claim, dispute, or controversy brought against us by you shall be resolved exclusively and finally by binding arbitration, under the Commercial Arbitration Act 1984.

Arbitration will be conducted before a single arbitrator, and will be limited solely to the dispute or controversy between you and us. The arbitration shall be held in a mutually agreed upon location in person or by telephone.

 

8. Copyright

8.1 – Ownership
All information on this website is subject to copyright owned by Magnets Australia. Any reproduction without prior written permission by Magnets Australia is prohibited.

 

9. Changes to this website

9.1 – Website Updates
Magnets Australia may update or revise these Terms of Trade, including the Privacy Policy, at any time. Changes to these Terms of Trade will take effect immediately once they are published on this website. You are responsible for regularly checking these Terms of Trade for changes. If you continue to use this website after we post changes to these Terms of Trade, you indicate your acceptance of such changes.

Note: All purchases are subject to Magnets Australia’s full terms and conditions which are available on request.

 

10. Shipping and Deliveries

10.1 – Courier Providers and Timeframes
Two courier services are used throughout all states in Australia being the below:

  • Our standard services uses Australia Post services to deliver within 5-20 business days.
  • Our express courier uses either DHL Express or FedEx Priority services to deliver within 1-5 business days.

Magnets Australia reserves the right not to ship to remote or rural locations. If you have made payment a full refund will be given.
Any orders that are dispatched to remote or rural locations may experience delays and Magnets Australia takes no responsibility for any delays caused by courier providers.

Orders being delivered by Australia Post have authority to leave the parcel in a safe location and may not collect a signature. DHL Express and FedEx orders require a signature or name to be delivered.

All customer orders, on completion, are automatically sent a track and trace link via email.
Should your parcel not be delivered within this timeframe, please contact us so we can raise a delivery query on your parcel.

10.2 – Same day dispatch
We guarantee same day dispatch of any order received under the condition that orders are received before 12:00 pm (AEDT) Monday to Friday. This is for Australia Post, DHL Express and FedEx services.
Our Same Day Dispatch Guarantee may be voided by factors outside of Magnets Australia’s control such as natural disasters or load volumes with courier services

10.3 – International clearance charges
Your order will be shipped from our warehouse in Auckland, New Zealand. As the buyer you are responsible for any tariffs, duty, import taxes, handling fees, or customs clearance charges required by Australia for importing consumer goods. We do not collect this beforehand.

Please do your research to ensure there are no surprise charges when clearing your package through customs, and to have an idea of what the additional cost may be. If you are unfamiliar with customs fees and charges, please speak to your local postal or customs office for more information. It is your full responsibility to verify the customs, duties charges, and procedures in your country prior to placing your order.
If customs fees and charges are refused at the time of delivery, your order will be returned and you will not receive a refund for shipment costs.
 

10.4 – Customer arranged collections
You may have your order collected from us by a registered international courier company and have the freight charged to your own account.

Any order that is being collected by your own freight provider will have a $10.00 handling charge added to your order to cover material and any time required for customs documentation.

 

11. Magnetic Superlifter 10 Year Magnetism Guarantee/Warranty Conditions

11.1. Scope of Warranty

  • This warranty exclusively covers the magnetic performance of the Magnetic Superlifter unit for a period of 10 years from the date of purchase.
  • The warranty applies solely to issues related to the loss of magnetism in the unit. Any other malfunction or damage is excluded from coverage under this warranty.

11.2. Exclusions

  • Damage resulting from improper use, mishandling, unauthorized repairs, or modifications will not be covered by this warranty.
  • The warranty does not cover physical damage, corrosion, or wear and tear on parts that do not affect the magnetism of the unit.
  • Any unit that has been exposed to extreme temperatures, chemicals, or conditions outside of its recommended usage parameters will be excluded from warranty coverage.

11.3. Registration Requirement

  • The unit must be registered with Magnets Australia within 30 days of purchase to be eligible for warranty claims by entering your details here.
  • Units that are not registered with us will have their warranty voided.

11.4. Annual Load Testing Requirement

  • The Magnetic Superlifter must undergo an annual load test, and evidence of each test must be submitted to Magnets Australia.
  • The first load test must be conducted within 12 months of purchase, with subsequent tests required annually for the warranty to remain valid.
  • Failure to collect evidence of load testing annually will void the warranty.

11.5. Claim Process

  • To initiate a warranty claim, contact Magnets Australia with your registration details, proof of purchase, evidence of annual load tests and send the unit back to us at

    Ensure that your information is displayed clearly on the return parcel so the sender can be identified.
  • The unit will be inspected to determine whether the issue relates to loss of magnetism and falls under warranty coverage.
  • If the claim is approved, Magnets New Zealand Ltd will repair or replace the unit at its discretion.
  • If the claim is rejected it is up to your company to arrange freight to collect the unit or we can ship the unit back to you at your cost.

11.6. Limitations of Liability

  • Magnets Australia shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the Magnetic Superlifter.
  • The maximum liability under this warranty shall be limited to the original purchase price of the unit.

 

12. Magnets Club Loyalty System

12.1 – Promotional Emails and Marketing Lists
By creating an account on our website you agree to be put into our marketing mail list and you will receive promotional emails from us. You may opt out at any time however by doing so you will immediately forfeit access to any existing discounts that you have earned and will no longer be eligible to receive further discounts. Any promotional discount codes will also immediately be made ineligible for use.

By being in our marketing mail list you will be eligible to earn discounts through our promotional system by increasing your 12 month spending history with Magnets Australia.

12.2 – Calculating previous 12 month spend
Your previous 12 month spend is calculated daily and only by orders that have been “Completed” where the order has been dispatched. Any order made under your online account and has been marked with the status as “Completed” will be factored into your previous 12 month spend.

By increasing your spend you may move up in tiers and by having previous purchases become older than 12 months may move down as this no longer becomes eligible to be factored into your previous 12 months of spend. Orders that have been refunded or cancelled will not be factored into your 12 month spend.
Should an order previously been eligible by being “Completed” and a refund request is made and accepted by Magnets Australia the value of the refund will be deducted from your 12 month spend.

Should a refunded order affect a following order that has been made, Magnets Australia reserves the right to calculate the true cost of the new order and refund the true balance that would occur after taking into account your reduced discount, this may mean you will receive less than what you have previously paid for your original order.

Orders made without being logged into your account will not be adjusted to be placed under your account, likewise orders made without being logged into your account will not be manually edited to include your online discount.

12.3 – Loyalty system adjustments/amendments 
Magnets Australia reserves the right to make adjustments to our loyalty system including but not limited to;

  • Spend required to reach each tier
  • Discounts and other benefits available at each tier
  • What products are eligible to be discounted under each tier
  • The right to discontinue our system in its entirety

We reserve the right to make any adjustments without previous notice, it is your responsibility as the consumer to check our Loyalty Perks page for any updates to the scheme. You will be notified by email regarding any changes that may impact your account.

12.4 – Re-subscribing after being removed from our marketing list
If you request to be removed from our marketing list we can re add you back into it on request making you eligible for our loyalty system however, your previous 12 month spend will commence from the date you re-subscribe. Any orders made before this date will not be factored into your annual spend.
